Austin man likely faces deportation following sentencing

A 21-year-old Austin man likely faces deportation after being sentenced on a felony forgery charge Monday.

Nicolas Millan-Aviles was ordered to a 366-day prison term, stayed three years. But he could be kicked out of the country by federal authorities before then.

According to a criminal complaint, Millan-Aviles was pulled over around 7:30 p.m. on Dec. 11 after an officer saw him driving down the middle of the road in Austin.

Millan-Aviles and two passengers in the car spoke limited English, according to the complaint. Only the driver eventually provided identification — an international driver’s license with no passport or local ID.

Millan-Aviles also did not provide proof of insurance.

The three were arrested. While at the jail, officers found three other forms of identification on Millan-Aviles, including a Mexican driver’s license and a U.S. Social Security card. The documents had different birth dates listed than his international driver’s license.

When asked about the discrepancy, Millan-Aviles admitted that be bought the Social Security card, the complaint states.

A registered alien card on Millan-Aviles’ person was also found to be linked to another individual. An ICE agent said Millan-Aviles was not found in a federal database and was likely in the country illegally.
